1. Introduction

These Terms govern Goodness Factory Living Essentials Private Limited's online properties, including websites, mobile applications, and the AI-based health platform called August.ai. Services include health information delivery via WhatsApp and related materials.

Users must review the Privacy Policy before accessing services. Acceptance of these Terms indicates consent to data collection and processing per the Privacy Policy.

2. General Statements

We believe conversational AI will transform technology interaction. Key points:

  • Use of Data: Conversation content and metadata will train models and develop new offerings
  • Acceptable Use Policy: Service usage must comply with stated policies
  • Information Accuracy: Users acknowledge information may lack reliability and shouldn't be used without independent verification

3. Acceptable Use Policy

Users must comply with the following rules:

  1. Adhere to applicable laws
  2. Avoid harmful or unlawful content
  3. No abusive content generation
  4. Don't upload defamatory or obscene material
  5. No impersonation
  6. Don't infringe others' rights
  7. Don't subvert security measures
  8. No reverse engineering
  9. No scraping or crawling
  10. No hacking or malicious code
  11. Don't forge message headers
  12. Secure your own network access
  13. Accept responsibility for data charges
  14. Don't publicly share chatbot outputs without written permission

Violations result in immediate access suspension without notice.

4. Registering for Services

Registration requires a phone number and full name. Users must use a controlled phone number and maintain account security.

Services prohibit registration for those under 18 years old. Suspected minor usage should be reported to [email protected] for account revocation.

5. Product Details

August AI

Provides health information via WhatsApp. Interaction with August AI does not guarantee a response and shouldn't substitute licensed provider consultation.

Beyond Lab Tests

Test results are accessible through the app. The company disclaims liability for third-party healthcare provider information. The doctor-patient relationship is solely between you and the chosen healthcare provider.

6. Fees & Payment

Services are currently free but we reserve the right to introduce subscriptions for specific regions.

India Model

Free access with monthly message limits. After exhaustion, monthly subscriptions required at displayed rates. Limits reset monthly; unused messages don't carry over.

Fees are charged in INR with GST. Third-party payment gateways process transactions; card details aren't stored. No refunds except where legally required.

Transparent pricing is displayed before confirmation. We do not use “dark patterns” such as pre-checked boxes or misleading buttons.

7. Medical Emergencies

Services aren't intended for emergencies. Users shouldn't delay medical care based on platform information. Emergency services should be contacted immediately.

8. Risks of Telehealth Services

Users acknowledge the following risks:

  • Transmitted information may be inadequate for accurate decision-making
  • Electronic equipment failures may cause delays
  • Incomplete medical records could lead to errors
  • Privacy breaches are possible despite security protocols

9. No Endorsements

We don't endorse specific providers, medications, or products. Third-party reliance occurs at your own risk.

11. Availability of Services

Services are limited to India's territorial jurisdiction. Users outside India are prohibited from access. Users warrant they are not prohibited by local laws from using these services.

12. Testing a Minor

Parents or guardians may create sub-accounts for minors under 18. Qualified adults represent they have legal authority to provide medical information. At 18, minors can transfer results to personal accounts via [email protected].

13. Electronic Communications

Users consent to electronic communications. All agreements and consents can be signed electronically. The company may contact users to verify account information. Failure to provide information within 14 days results in access suspension.

15. Third Party Services

We provide links but aren't responsible for third-party content or services. Users assume all transaction risks. No warranties apply to third-party providers. Users pay associated fees independently.

16. Third Party LLMs and APIs

User queries may be transmitted to third-party LLM owners and their servers internationally.

17. Additional Terms

Channel Integrations

Subject to respective company approval. WhatsApp bot integration requires Meta/WhatsApp approval and Facebook Business Manager verification.

Source Code Ownership

The company retains all source code rights unless these Terms specify otherwise.

Prompt Use

All conversation data trains our AI/ML models.

Platform Ownership

Beyond shall have entire and exclusive right, title, and interest over the Site, App, and Platform. Users claim no rights to platforms or bots.

18. Proprietary Rights

The platform is exclusive company property under Indian and international copyright law. Users receive a revocable, non-transferable, personal, non-exclusive use license.

Content cannot be reproduced, duplicated, copied, sold, or exploited commercially without written consent. Framing techniques and meta tags incorporating company information are prohibited.

19. Accuracy of Information

While we strive to maintain accuracy, we make no representations or warranties regarding the correctness or accuracy of information. Content may contain errors. The company retains discretion to modify or discontinue features without notice.

20. Updates

Updates are provided at company discretion, potentially with additional fees. No obligation exists to continue production.

21. Advertisements

Services may display targeted advertisements. Users cannot block ad display. Advertising scope may change without notice.

22. User Information

Users shouldn't provide false, defamatory, abusive, or unlawful information. Submitted information can be de-identified and disclosed to third parties for analytics and research.

Users must not:

  • Access services unlawfully
  • Post false identity messages
  • Transmit libelous or defamatory content
  • Impersonate individuals
  • Tamper with platform functionality
  • Use bots or scripts
  • Reverse engineer code
  • Harvest health information about others
  • Infringe intellectual property rights

Users indemnify the company against third-party claims arising from submitted information.

24. Intellectual Property

With the exception of your electronic medical record, we and our licensors retain all right, title, and interest. Information cannot be stored, copied, modified, or distributed. Trademark and logo use is prohibited without written permission.

25. Disclaimer of Warranties

The company does not warrant that the services will be uninterrupted or error free. Services are provided “as is.” All warranties, express and implied, are disclaimed, including merchantability and fitness for a particular purpose.

At no instance shall the company be liable for any answer, content, reply, or information provided through the services.

26. Limitation of Liability

To the fullest extent permitted by law, the company shall not be liable for lost profits, data loss, or consequential damages. Direct damages are capped at the greater of INR 8,000 or total fees paid in the preceding 12 months.

29. Arbitration & Dispute Resolution

Governing Law

Indian laws apply without conflict provisions. Arbitration is governed by the Arbitration and Conciliation Act, 2015. Bangalore, Karnataka courts have exclusive jurisdiction.

Arbitration Process

Disputes first require amicable resolution attempts. Unresolved disputes proceed to a single arbitrator identified by the company, with proceedings in English. The company may seek injunctive relief for intellectual property violations.

30. Force Majeure

The company isn't liable for breaches caused by uncontrollable events including acts of God, terrorism, hacking, cyber-attacks, natural disasters, or civil disorder.

31. Indemnification

Users indemnify the company, affiliates, and employees against all liabilities, losses, claims, and expenses arising from service misuse, Terms or Policy violations, submitted content, or negligent acts. The company reserves exclusive defense control rights.

37. Miscellaneous

These Terms and Privacy Policy constitute the entire agreement and supersede prior communications. Unenforceable provisions are minimized to preserve enforceability. Non-exercise of rights doesn't constitute waiver. Terms are personal and non-transferable without consent.
